The NFA Registration Is Gone: What Silencer Shop Foundation v. ATF Win Means for You
The Ruling Is in Effect. Suppressors Are Officially Off the NFA in Free States.
As of today, the court’s ruling in Silencer Shop Foundation v. ATF is officially in effect. In the 27 Free States, suppressors are off the NFA entirely — no Form 4, no fingerprints, no ATF wait time, and no registry. A suppressor now transfers like any other firearm: pass a standard background check at your dealer and walk out, typically the same day.
Here’s where every state stands as of today:

Free States (27) — No NFA process. Alabama, Arizona, Arkansas, Florida, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Minnesota, Missouri, Nebraska, New Hampshire, New Mexico, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, West Virginia, and Wyoming. Buy a suppressor like any other firearm — standard background check at your dealer.

NFA States (15) — The NFA process still applies. Alaska, Colorado, Connecticut, Georgia, Michigan, Mississippi, Montana, Nevada, North Carolina, North Dakota, Ohio, Oregon, Pennsylvania, Washington, and Wisconsin. State law still requires the Form 4 process here, and we handle the paperwork end to end — same as always.

Banned (8 states + D.C.). California, Delaware, Hawaii, Illinois, Massachusetts, New Jersey, New York, and Rhode Island, plus Washington, D.C. Suppressors are not currently legal in these places, and we’re fighting to change that.

On August 5, 2026, in a victory in our lawsuit Silencer Shop Foundation v. ATF, a federal court ordered the ATF to stop enforcing NFA registration against Silencer Shop customers. No Form 4. No federal registry entry. No waiting on the government to bless a purchase you already paid for. You buy your suppressor, pass the same background check you'd pass for a rifle, and take it home that day.
And to be clear about what the real news is: Congress already made the tax stamp free back in January. That was never the hard part. The hard part was the registration, and the registration is what just fell. This is the biggest hit the NFA has taken since it was written in 1934.
What Is Changing
For 91 years, the federal government kept a file on every legal suppressor in America. To own one, you had to register it, hand over your fingerprints and photos, ask the ATF for permission, and wait months for a form to come back approved. That registry was the entire point of the National Firearms Act. For our customers, it'll be gone soon.
The change is simple. The government no longer gets to force Silencer Shop customers to register a suppressor, and it no longer gets a record of the ones you buy from us.
The Form 4. The approval wait. The federal registry entry. All the paperwork that made buying a suppressor feel like applying for a security clearance. A court just told the ATF it can't enforce any of it against our customers. What's left is an ordinary sale over the counter, just like any other firearm.
The Court issued a 7-day stay, so all these changes are currently set to take effect by August 12, assuming the stay is not extended.
Why It Happened, and Why Our Name Is on It
The whole registration scheme stood on one leg: a tax.
Back in 1934, the government couldn't simply ban suppressors, so it taxed them and used that tax as its excuse to force you to register. For 91 years the trick held. Then in 2025 Congress passed “The Big Beautiful Bill” that dropped the tax to zero dollars, effective January 2026. No tax meant no reason for the registration. The leg was gone, but the scheme was still standing.
Silencer Shop Foundation is the one that pushed it over. We brought the case as lead plaintiff, argued that a zero tax can't justify a federal registry, and won. Thanks to all of the support from our customers, and folks who have donated to Silencer Shop Foundation, we beat the ATF in court. Now all of you, the people who made it possible, get the benefits.
What It Means When You Buy From Us
Buying a suppressor from Silencer Shop, in a state where they're legal, will work like this:
- No Form 4 and no ATF approval. Nothing gets mailed off and sat on for weeks.
- No registration. Your suppressor doesn't go into a federal database.
- No wait. You're not stuck for half a year on a stamp.
- Same as a rifle or handgun. Pass a standard background check and walk out with it.
Where This Still Doesn't Apply
A handful of states ban suppressors on their own, and a federal court can't rewrite state law. Suppressors are still illegal for regular folks in the states below. As always, check your local and state laws, but the federal side just got a lot simpler.
